REMOVAL DEFENSE



We defend immigrants from removal. We work with detained and non-detained people in removal proceedings before the Immigration Court, as well as at the Board of Immigration Appeals and the Ninth Circuit Court of Appeals.



"CRIMMIGRATION"



One of our areas of interest is the intersection between immigration law and criminal law. We analyze the immigration consequences of current charges, or past convictions. Some convictions can be attacked after the fact which can alter the immigration consequences of the conviction. If a "post-conviction" attack would be beneficial, we connect immigrants with competent post-conviction counsel.



FOR CRIMINAL DEFENSE ATTORNEYS



We work directly with criminal defenders to analyze the immigration consequences of a plea to current charges. We can help craft an immigration-neutral plea, or, at the very least, help defenders fully advise clients of the immigration consequences.



FAMILY IMMIGRATION and permanent residence



Often, US citizens and permanent residents can file an "alien relative" petition for their relatives, which leads to permanent residence (a "green card") for the relative. This process might take place in the ​United States or at a consular post abroad. Often the process will require a waiver (or "pardon") application as well.



citizenship and naturalization



A permanent resident can apply for US citizenship after five years -- or three, in some cases. We will analyze the case for potential complications (particularly those arising from criminal convictions) and represent the immigrant throughout the process. ​



appeals and motions



We have an active appellate practice, at the BIA and the Ninth Circuit Court of Appeals. Often, changes in a case will support reopening of removal proceedings, and we can file a motion to reopen with the Immigration Court or the BIA as warranted.



visas for victims of violent crime in the united states



Often, an immigrant victim of a violent crime in the United States will qualify for a "U" status (or a "U-visa"). Where the victim has cooperated with law enforcement, and law enforcement has certified the cooperation, a U-visa becomes possible. These are currently taking many years for USCIS to process. However, if granted, an immigrant with U-status can later apply for permanent residence.

We are available to write briefs and motions for immigration practitioners. We also make appearances at the Immigration Court and USCIS offices on behalf of other attorneys.

We represent immigrants who are applying for various forms of immigration benefits. We prepare and file asylum applications, and appear at the USCIS asylum office. We file work permit applications where possible. We file TPS applications if possible. We explore any available options for our clients.
